Limitation of Liability

In no event shall ShoreVacations.com be liable for any special, indirect, punitive, incidental, exemplary or consequential damages, or any damages whatsoever resulting from loss of use, business, data or profits, litigation and the like, whether based on breach of contract (including negligence), product liability or otherwise, even if advised of the possibility of such damages. You acknowledge and agree that the limitations set forth above are fundamental elements of this agreement.

Indemnification

You agree to indemnify, defend and hold harmless ShoreVacations.com, its affiliates and members from any liability, loss, claim and expense (including attorneys' reasonable fees) related to (i) your violation of this agreement, and (ii) your posting of material to this site.

Proprietary Rights

All materials on this site, except property information and photos, (as well as the organization and layout of the site) are owned and copyrighted by ShoreVacations.com and may be accessed, downloaded or printed for your personal non-commercial use only. Without the prior written permission of ShoreVacations.com or its suppliers, you may not copy, distribute or transfer any material on this site, except for property information and photos, for in whole or in part.

Changes to Site

ShoreVacations.com and its suppliers may make improvements or changes in the information, services, products, and other materials on this site, or terminate this site, at any time without notice. ShoreVacations.com may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement. Accordingly, you agree to review the agreement periodically, and your continued access or use of this site shall be deemed your acceptance of the modified agreement.

Miscellaneous

Property Listings

Owners are responsible for the accuracy of the information on their property listings. Owners who provide photos to be used assert that the photos are their own property and these same owners have the publishing rights to said photos. ShoreVacations.com is not responsible for any action, or omission of action, by any renter obtained by the use of this site. ShoreVacations.com and its affiliates are not liable in any dispute between renters and owners that established contact through any of its sites

Notice to All Users

You are responsible for conducting your own investigation regarding any and all claims made by prospective renters or vacation property owners or agents. You assume all liability for use of any information you find in any ShoreVacations.com publication. The operators of ShoreVacations.com assume no responsibility and in no way warrant the accuracy of the information contained in any of the pages published here. Not all ShoreVacations.com ads are created directly by the property owners, some ShoreVacations.com advertisers are acting as agents or managers for the owners.

Renters are aware that each property sets it's own refund and cancellation policies - ShoreVacations.com recommends that renters ask for and receive a written notice of the refund/cancellation policy from the advertiser and for added protection, we recommend the purchase of Trip Cancellation Insurance at your own expense. ShoreVacations.com is not responsible for the refund of rental fees for any reason.

None of the information contained in any ShoreVacations.com web page is confirmed or warranted by any party. Confirmation of information published herein is the sole responsibility of the renting party. Qualification of all renters is the sole responsibility of the property owner or agent. ShoreVacations.com is not a licensed real estate broker in any location.

Notice to Property Owners

If the operators of ShoreVacations.com are unable to provide the promised level of service for any reason, including, but not limited to service outages, war, acts of God or negligence, neither ShoreVacations.com or it's owners can be held liable for any costs beyond the prorated costs paid by the client for the services which were not provided. ShoreVacations.com does not guarantee that the web site will be available 100% of the time. ShoreVacations.com reserves the right to reject or edit any listing submitted at our sole discretion.

Membership Cancellation Policy
ShoreVacations.com listings run on an annual basis. Due to the fact that the vast majority of the work involved in promoting vacation properties on the Internet occurs in the first few weeks (creating the ad, adding photos, submitting to search engines, etc) ShoreVacations.com is unable to offer a refund on cancelled memberships.

Property Off the Market
If you wish to remove your property from the market, we can temporarily inactivate the ShoreVacations.com listing and reactivate it at a future date. Your ShoreVacations.com listing stays in force through the original term and the renewal date does not change (the renewal date will not be extended during the time that the property is off the market).

Spamming Policy

ShoreVacations.com does not participate in or tolerate the sending of Unsolicited Commercial Email (Spam) - we reserve the right to cancel (without refund) any member that mentions ShoreVacations.com or any of it's associated websites, URLs, or any associated ShoreVacations.com email address in any spam e-mail message or Usenet posting. ShoreVacations.com is the sole judge in determining what constitutes spam.

Rental Inquiries
It is the goal of ShoreVacations.com to reduce the volume of spam delivered via the Rental Contact Form. To that end, inquiries may be monitored and filtered by ShoreVacations.com prior to delivery to our members. Inquiries may be read by ShoreVacations.com staff members. Despite ShoreVacations.com's filtering efforts, it is likely that some spam inquiries will be delivered anyway. It is also likely that some non-spam inquiries may be be not be delivered as a result of our filtering efforts. Rental inquires are delivered via Internet email and are not to be considered private. Internet e-mail delivery is not 100% reliable and ShoreVacations.com cannot be held responsible for undelivered inquiries or for missed income as a result of undelivered inquiries. ShoreVacations.com, at its own discretion, may supply to potential renters the direct e-mail address of ShoreVacations.com advertisers for the purpose of making a rental inquiry.

Privacy Policy

We do not collect personal information, such as e-mail address or telephone number, from you on our site unless you register, complete a form or enter a contest. If you list or advertise a vacation rental with ShoreVacations.com, we collect your personal information for billing purposes only.

Registration & Other Forms
When you request vacation rental availability, we collect your name, e-mail address and phone number. This allows the vacation rental owner to respond to your request. When you enter a contest or complete a survey, we may ask for your name, address, and e-mail address so we can administer the contest and notify winners. We may also use the information we collect to notify you occasionally about new ShoreVacations.com services, promotions and special offers we think you'll find valuable. The contact information may also be used to send promotional material from some of our partners to our registered members.
